Crypto tax in Belgium
Belgian crypto taxation is not a single rate but a classification exercise: what kind of investor are you? The same bitcoin gain can be untaxed, taxed as miscellaneous income, or fall under professional income depending on the circumstances. We explain below the three categories, how filing works in practice, and what records you need. It is general information, not tax advice; discuss your own situation with an accountant.
The three categories
The first is normal management of private wealth, described in law as acting like a prudent person. Investing your own money, holding positions for longer periods and avoiding leverage or complex products usually places you here, and gains are in principle not taxed as miscellaneous or professional income.
The second is speculation: gains outside normal management are taxed as miscellaneous income at 33% plus municipal surcharge. Indicators include high trading frequency, short holding periods, borrowing or leverage, and committing amounts out of proportion with the rest of your wealth.
The third is professional activity. Organising yourself like a trader, with dedicated infrastructure, systematic strategies and a substantial share of income from it, means progressive income tax rates plus social contributions.

New levies and why you re-check the current state
Belgian rules on taxing financial capital gains have been amended and refined several times through programme laws and implementing decrees. For crypto that means an article from two years ago may be outdated: check what the federal tax administration (FOD Financiën / SPF Finances) publishes for the relevant assessment year on gains from financial assets and on reporting duties.
Separately, accounts held with foreign providers must be reported in the personal income tax return, and in some cases also to the National Bank's Central Point of Contact.

Asking the ruling commission
If you are unsure whether your activity still counts as normal management, you can request an advance ruling from the ruling commission (DVB/SDA). You describe your situation, strategy and numbers and receive a binding position for those facts. It takes time but gives certainty before unwinding a large position.
Anonymised rulings are published, and a pattern emerges: frequency, leverage, proportion to total wealth and degree of professionalisation weigh more heavily than the absolute profit.
Records that keep your filing standing
Record date, coin, quantity, euro price, fees and counterparty per transaction, and export CSV files from every platform and wallet at least annually. In an audit a complete series matters more than a neat summary: the inspector wants to bridge your bank account, your platform and your wallet addresses.
Track staking, lending and airdrop income separately, valued at receipt. Those flows are assessed differently from capital gains and need their own trail.

Frequently asked questions
Do I pay tax just for holding bitcoin?
Merely holding is not a taxable event in Belgium. The question arises on sale or exchange, and the treatment then depends on how your activity is classified.
Is a coin-to-coin swap taxable?
A swap can be a realisation moment and certainly counts when assessing whether you trade speculatively or professionally. Log each swap with its euro value at the time.
Must I report a foreign crypto account?
Accounts with foreign providers belong in the personal income tax return. Check per assessment year whether a Central Point of Contact notification is also required.
What if I never reported anything in the past?
Talk to a tax adviser. Voluntary correction is generally better than waiting for data to arrive through the European exchange of crypto information.
