Explanation

In Belgium treatment depends on whether you act prudently, speculatively or professionally. The Netherlands taxes wealth in box 3 rather than realised gains. Always have your situation checked by an adviser.

The Belgian framework

Belgium has no general capital gains tax on private assets, but three possible qualifications. Normal management of private assets: untaxed. Speculative or miscellaneous income: 33 percent plus municipal surcharge. Professional income for organised, frequent trading: progressive rates up to 50 percent plus social contributions.

What influences the qualification

The ruling commission examines trading frequency, the share of your wealth involved, use of borrowed money, leveraged products, professional knowledge and the time you spend. Buying and holding for years leans strongly toward untaxed; daily margin trading leans toward professional income. In doubt, you can request an advance ruling.
